The Namibian Competition Commission (NaCC) has found NamPower, Telecom Namibia, and MTC guilty of unfair business practices. The three companies signed an exclusive agreement on June 1, 2012, which gave them an unfair advantage in the market.
According to the NaCC, this agreement broke several rules under the Namibian Competition Act of 2003. The investigation focused on a deal called the “Tripartite Agreement,” which allowed Telecom Namibia and MTC to share and manage NamPower’s dark optic fiber network as joint operators.
Despite these findings, the NaCC has not yet made a final decision on the case, reported said by NaCC’s Corporate Communications Practitioner, Dina //Gowases.
