State Argues Against Special Treatment in NAMCOR Bail Hearing – The Updated World

State advocate Basson Lilungwe has urged the Windhoek Magistrate’s Court not to grant any special treatment to the accused in the ongoing NAMCOR-related bail hearing, stressing that “everyone is equal before the law.”

Lilungwe made the remarks on Friday while responding to submissions by defence lawyers who had raised concerns about alleged irregularities during the arrests of the accused by the Anti-Corruption Commission (ACC). He argued that such issues should have been challenged through a separate court process, adding that the current proceedings are limited to bail considerations.

“The matter before this court is not a trial. None of the accused have been asked to plead to the charges, which remain preliminary and could change as the case progresses,” Lilungwe emphasized.

He further addressed alleged contradictions in the testimony of ACC investigator Oberty Inambao, acknowledging inconsistencies but insisting they were “not material” to the bail application.

Lilungwe also requested the court to place minimal weight on affidavits submitted by Olivia Dunaiski and Leo Nandago, citing their absence for cross-examination.

The bail hearing, which has drawn significant public interest, is set to continue.
