The Electoral Court has temporarily pause the Independent Patriots for Change (IPC)’s legal challenge to nullify the results of the 2024 National Assembly elections.

Judge Hannelie Prinsloo ruled that while the case will be treated as urgent and resolved before March 21, it will remain on hold until the Supreme Court delivers its decision on the Presidential election challenge. The Supreme Court hearing is scheduled for February 10.

In her judgment, Prinsloo emphasized that the suspension of proceedings is temporary and not a final decision. She explained that the Supreme Court’s ruling would guide and narrow the scope of the Electoral Court’s deliberations regarding the National Assembly election dispute.

Prinsloo dismissed objections from lawyer Sisa Namandje, who argued that the delay would disrupt Swapo’s governance preparations. The judge maintained that the temporary pause would not significantly affect the party’s plans to lead the country.

Last week, the Electoral Court invited submissions from the IPC and other respondents on whether the case should be deferred. The court reaffirmed its commitment to aligning its actions with the Supreme Court’s rulings to ensure consistency in legal decisions.

The IPC’s case now hinges on the outcome of the Supreme Court hearing, which is expected to provide clarity on broader electoral disputes stemming from the 2024 elections.
