State’s Attempt to Revoke Willemse’s Bail Dismissed on Procedural Grounds

Cedric Willemse will remain on bail after the Windhoek High Court declined to entertain the state’s application seeking its cancellation. Willemse was granted bail of N$200,000 in October 2025.
The matter was struck from the roll after the court identified procedural deficiencies in the filing of legal documents connected to the application. The required paperwork, according to the court record, had not been submitted in compliance with established rules.
During proceedings, state prosecutor Basson Lilungwe asked for additional time to submit the state’s heads of argument. He explained that he was engaged in another appeal involving other suspects linked to the same case.
The court, however, refused the request and removed the application from the roll.
In a related bail appeal heard last week, defence lawyers including those representing Willemse’s co-accused were required to explain their failure to follow certain legal processes. Judges Philanda Christiaan and Eileen Rakow allowed the legal teams to proceed with their arguments despite the procedural concerns raised.
