Doctor Noa Says 26-Year-Old Male Complainant Agreed to Have Sex With Him
Medical doctor Dennis Iipumbu Noa has told the Ondangwa Magistrate’s Court that he had sex with a 26-year-old male complainant but denied that any force was used.
Noa, 31, is facing a rape charge arising from an alleged incident at his accommodation at Onandjokwe Intermediate Hospital. The case involves a male complainant, who is alleged to have been sexually assaulted at the hospital premises.
Giving evidence during his bail proceedings, Noa said he knew the complainant and that the two had been drinking at two establishments in Ondangwa before going to his residence.
He told the court that the complainant asked to stay at his accommodation because he was too intoxicated to drive. Noa disputed the allegation of force and maintained that the sexual encounter happened willingly.
“There was no force used and that day we had sex,” Noa told the court.
The latest case comes after Noa was previously involved in a separate rape case concerning an 18-year-old male patient at Katutura Intermediate Hospital in 2021.
Noa was initially convicted and sentenced to eight years in prison in that matter. However, the Windhoek High Court overturned the conviction in November 2024 and acquitted him, finding that the State had failed to prove the case beyond reasonable doubt. The State later sought leave to appeal the acquittal, but the High Court dismissed that application in February 2025.
In the current matter, the State has previously opposed bail, citing the seriousness of the charge and concerns about possible interference with witnesses and ongoing investigations. The Health Ministry has also launched an internal administrative investigation alongside the police investigation.
Noa remains presumed innocent unless and until a court finds him guilty.
His bail proceedings are expected to continue on Wednesday.
