Malema’s Jail Fate Delayed as Court Reviews Pre-Sentencing Reports

Hundreds of supporters gathered outside the East London Magistrate’s Court on Friday as political leader Julius Malema awaited the next step in his firearm case. The court has postponed the final sentencing, giving both the defence and prosecution time to submit further reports and arguments. Malema will not know whether he will face jail until mid-April 2026.

Malema, leader of the Economic Freedom Fighters (EFF), was convicted in October 2025 on multiple firearm-related charges, including unlawfully possessing a gun and discharging it in public at a 2018 rally. The offences carry potentially severe penalties, with imprisonment of up to 15 years.

During the pre-sentencing proceedings, a social worker presented a detailed report suggesting that Malema may not be suitable for direct imprisonment. The report recommended alternative measures such as a suspended fine, restrictions on firearm licensing, or contributions to community initiatives aimed at preventing gun violence.

Prosecutors emphasized the seriousness of the crimes, noting the potential danger of firing a weapon in a public space. They indicated that they would push for a custodial sentence. If Malema is sentenced to more than 12 months in prison without the option of a fine, he could lose his parliamentary seat under South African law.

Outside the courtroom, EFF supporters in red berets showed visible support for their leader, while Malema himself maintained that his actions were celebratory rather than malicious. He also reaffirmed his commitment to his political mission, stating that he would not retreat from advocating for his followers.

The court has now scheduled the next hearing for 15 and 16 April 2026, when it will consider all reports and arguments before delivering a final decision on Malema’s sentence. Until then, the political and legal spotlight remains firmly on the EFF leader.
